Electronic Records & Signature Policy
This Electronic Records and Signature Policy governs your consent to receive records electronically and to use electronic signatures in connection with D³ forms, agreements, and submissions.
1. Consent to Electronic Records
By submitting any D³ form, application, or agreement, you consent to receive all records, notices, disclosures, and communications related to that submission in electronic form. This includes confirmation emails, copies of signed agreements, and any required disclosures.
Your consent applies to the specific transaction for which you provide it. You may withdraw consent at any time by contacting info@dtothe3.com, but withdrawal will not affect the validity of any electronic records or signatures already provided.
2. Electronic Signatures
D³ uses electronic signatures in connection with its forms and agreements. By typing your full legal name in a signature field and submitting a D³ form, you are providing an electronic signature with the same legal effect as a handwritten signature, to the extent permitted by applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law.
Your electronic signature represents your agreement to the terms of the document you signed, your certification that the information you provided is accurate, and your request to receive an electronic copy of your completed submission.
3. What We Record
For each electronically signed submission, D³ records:
- Your typed legal name (electronic signature)
- The date and time of submission (UTC)
- The document title, document ID, and version you agreed to
- The specific acknowledgment checkboxes you checked and their exact text
- Your email address
- Your IP address (where technically available and legally appropriate)
- A unique submission ID
This information constitutes the audit record for your submission. D³ does not alter executed audit records. If a correction is needed, a new submission or amendment is required.
4. Copies of Your Records
After each submission, D³ will email a copy of your completed submission and electronic signature receipt to the email address you provided. Please retain this email for your records. If you do not receive a confirmation email, contact info@dtothe3.com.
5. Hardware and Software Requirements
To access and retain electronic records, you need a device capable of accessing the internet, a current web browser, and an email account. You should be able to print or save electronic records for your own records.
6. Withdrawal of Consent
You may withdraw your consent to receive electronic records at any time by contacting info@dtothe3.com. Withdrawal does not affect the validity of any electronic signature or record already provided. If you withdraw consent, D³ may be unable to process future submissions electronically.
