Location Release

This Location Release ("Release") governs D³'s use of a location for filming, photography, and recording. The location owner or authorized representative ("Location Owner") grants D³ the rights described in this Release.

1. Grant of Rights

Location Owner grants D³ the right to enter and use the Location for filming, photography, recording, and related Production activities, use footage, photographs, and recordings of the Location in D³ Productions, depict the Location in D³ Productions including identifying the Location by name if applicable, and distribute and broadcast footage of the Location on D³ Platforms and through D³ distribution partners.

2. Filming Period

The filming period will be agreed between D³ and Location Owner in advance. D³ will use commercially reasonable efforts to complete filming within the agreed period.

3. Condition of Location

D³ agrees to leave the Location in substantially the same condition as found, repair any damage caused by D³'s filming activities, comply with Location Owner's reasonable rules and requirements, and remove all D³ equipment and materials from the Location upon completion of filming.

4. Compensation

Unless a separate written agreement specifies compensation, this Release is granted without compensation. Location Owner is not entitled to any payment, revenue share, or other compensation for the rights granted herein.

5. Location Owner Representations

Location Owner represents and warrants that Location Owner has the legal authority to grant the rights in this Release, the Location does not contain any hazardous conditions that D³ has not been informed of, and granting these rights does not violate any agreement, obligation, or law applicable to Location Owner.

6. Release of Claims

Location Owner releases D³ from any and all claims arising from D³'s use of the Location as described in this Release, provided D³ complies with its obligations in Section 3.

7. Governing Law

This Release is governed by the laws of the State of Texas.
