Promotion Winner Agreement

This Promotion Winner Agreement ("Agreement") governs the terms under which D³ may use the name, likeness, and statements of a promotion winner ("Winner") in connection with D³ promotions. By accepting a prize, Winner agrees to this Agreement.

1. Publicity License

Winner grants D³ a non-exclusive, royalty-free, worldwide license to use Winner's name, city and state of residence, photograph, voice, and statements about the Promotion for advertising and promotional purposes in any media, including social media, television, radio, print, and digital, without additional compensation.

2. Statements

Winner agrees to cooperate with D³'s reasonable requests for statements, photographs, and appearances in connection with the Promotion. D³ may edit Winner's statements for length and clarity.

3. Prize Acceptance

Winner accepts the prize as described in the Official Rules. Winner acknowledges that the prize is provided "as is" and that D³ makes no warranties regarding the prize. Winner is responsible for all taxes on the prize.

4. Release

Winner releases D³ from any and all claims arising from Winner's participation in the Promotion or receipt or use of the prize, including claims arising from the use of Winner's name and likeness as described in this Agreement.

5. Representations

Winner represents and warrants that Winner is eligible to participate in the Promotion under the Official Rules, Winner has the legal capacity to enter into this Agreement, and all information Winner provided in connection with the Promotion is true and accurate.

6. Governing Law

This Agreement is governed by the laws of the State of Texas.
